I have the same situatation and called them numerous times. They say they will honour the actual date that is written on the receipt and not on the web site. When you call USCIS, you have to tell them that your receipt date is different than what is displayed on the web stie.

Hello,
It seems that I made a mistake in my DS-160 and my H1B got stamped with an error in my middle name. I repeated my lastname as my middle name so my full name appears as: 1stName 1stLASTNAME 1stLASTNAME 2ndLastname
I have a Tourist Visa also stamped wich is OK. Also the data on my passport.
My I797 is OK and everything else is OK.
I am still in my home country. Should I be worried about it? Should I try change it here or in the US?
In any event, what's the correct procedure to change it?

Do you have a work permit to enter Canada. A Business visa is not good enough?
Re entry to US every week is going to get increasingly trickier.

Hello,
Recently I applied for AP. It was approved on Oct 20, 2009 but when I got the document from USCIS I found that the effective date of my AP is from 12/20/2009 to 12/19/2010. My question is,
1. I want to go to India on 26th Nov and return on 20th December. Some of my friend told me that I can travel between 12/20/2009 to 12/19/2010 not not before 12/20/2009. Is it correct.
2. My understanding was I can go to India before effective date which is 12/20/2009 and can return on or after 12/20/2009. Is this correct.
Please respond as I want to go to India on Nov 26th 2009 due to some emergency.

I am planning to visit Canada next month and want to enter USA with the help of AP. My question is Can I continue my salary using H-1B with the same employer? I read somewhere that I can use my H-1B for salary processing in such circumstances provided I am working for same employer.

I am currently working in Michigan. My PD is "Feb 2006" and my 485 has been filed during 2007 July fiasco. My 140 was approved in April 2008.
I planing to move a different company in Connecticut on my EAD ( valid till 2010 end). But Connecticut falls under Texas SC where as my GC is filed in Nebraska.
Do you feel this is an issue. What kind of headache this can cause?

I renewed EAD twice using e-file. So far it was all smooth. Very first time I had paper filed and went for FP-ing. Since then renewed twice for myself and my wife - no FPing...got the card smoothly. Again this is USCIS .. someone might have had completely different experience...

USCIS continues to streamline its processing of applications and petitions with the recent change in filing locations for several forms. The following forms should be mailed to USCIS lockbox facilities rather than directly to USCIS Service Centers:

* I-130
* I-140
* I-526
* I-539
* I-817
The updated filing instructions can be found on the latest versions of each form, which are available for free from USCIS.
This change became effective August 3, 2010.If you recently mailed an application. Applications already en route to the Service Centers will be automatically forwarded to the appropriate lockbox for a period of 45 days. After September 17th, packages (including fees) will be returned to the applicant along with a note explaining the new filing instructions.

I understand the wages lesser than specified in Labor is a real potential issue. But what about wages much higher than specified? 10-20% increase will be fine, but what about 50% or 100% jump.
Many of us live in consulting world and in a billing sharing mechanism where your annual wages fluctuates. I am talking to a potential client which can give me a significant raise (please note I am not transferring H1 or using EAD and will be staying with the same GC filing company with 140 approved and 485 pending).
Has anyone ever met a real case when high wage jump created a problem?

Applied for LCA before H - 1 B renewal and got the error "FEIN ID NOT FOUND " error. I submitted additional documents still waiting for reply from DOL. Applied for LCA on august 5 , got the reply "FEIN not found" on august 13, faxed additional documents on same day still did not hear back from DOL.. Pls advice how long it will take now???????

This is complicated. IF you are a citizen or if your wife has any US.S. citizen parents, she can file I-601 waiver application. But if your wife made unlawful entry , departed the U.S and reentered the U.S, then she is subjected to a permanent bar, and she cannot apply for a waiver for a period of 10 yrs. You need to consult a good attorney.

You are already counted in the quota. So it is just transfer. But for transfer need recent paystubs. Consult a lawyer how to handle this. Definitly you no need to wait for April 1 st quota for new H1B.
