The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise. hi attorneys,
my H-1B petition is valid for another 3 months. we applied for my H1 extn and my spouse H4 extn 2 months ago. both r still pending.
my spouse H4 petition expired last month. since we applied extn b4 it expired, my spouse can stay in usa legally.
now my spouse wants to travel abroad for a family function.
questions:
(1) is it fine to travel abroad with H4 extn pending? (pls note that the H-1B holder will not be traveling)
(2) if H4 extn is approved with new I-94 when abroad and my spouse gets another new I-94 at POE when returning, then which I-94 will be the latest valid one?

Pew confirms what we've already assumed is happening. The number of illegally present immigrants has dropped 8% since 2007. The number is now about 11 million, down from peaking at 12 million. The annual migration of illegally present immigrants has dropped from about 850,000 a year a few years ago to just 300,000 a year today. Why? Hi All,
I have applied I-485,I-765 and I-131(AP) for my wife as derivative when my priority date(March 26th 2006) became current on September 1st.
We recieved the Reciept notices for I-485,I-765 and I-131(AP) for my wife on September 30th.
My I-485 got approved on 11/05 .We didnot recieve FingerPrint notice still.
I would like to know how much time it generally takes for derivative I-485 approval .

Any I-485 approvals from Nebraska.. for EB3-I in the month of Jan..
My finger printing was done in Sep-2007 .....took an Infopass and opened a SR .The IO officer @ infopass said that the finger printing has to be initiated from Nabraska...any body on the same boat

I applied GC for me and my spouse thro' EB3, AOS in July 2007, with Priority date 2005.
Currently I am in H1B and my spouse uses EAD to work.
2nd case:
My spouse applied the labor process and planning to apply I-140 in EB2 and choose CP process , once Labor approved.
Question:
For Spouse:
Is it possible to use EAD (1st case, as benificiary) to work and go for CP in 2nd case (Primary)?.
For me:
Can I add my name in CP (as Benificiary), with out effecting the my process AOS/H1B (1st case)

Normally, entering into the US follows the last entry rule. Thus, whatever status a person last enters on is their status.
There are special regulations when it comes to H-1b status and travelling on AP. I would speak with an attorney prior to travelling.

A hand written personal greeting card will be a good idea (no e-cards please)
A short note regarding our issues will not be a bad idea, also do not forget to put ImmigrationVoice.org in your signature! Thousands of cards with IV signature will also help IVs exposure :)

I had been in H-1B status and was laid off. My H-1B was withdrawn by my company on 12/31/2010. I applied for COS to B2 and received the USCIS receipt notice on Dec 17th, a few days before my H-1B was withdrawn.
Later on Feb 2nd, 2011, I received the approval notice from USCIS for B2 valid from 02/02/2011 to 04/29/2011(I had informed in my application that this would be my date of departure.) My question is: What status would I be from the date my H-1B was withdrawn till the B2 validity start date?
