Hi,
I have been searching in the inernet for quite some time and looks like
the following questions are still not answered properly. So any of you here who actually used the AC21 in the past can answer the below questions and it will help lot of people on this board.
1) When the employee don't have I-140 receipt number and I-140 approval copy , is it okay to use AC21 after 180 days ?
2) Do we need to have I-140 approval copy for the EAD renewal ?

I was on H1 visa and laid off from job on 10/30/09. I got severance pay for Nov. and have the pay stubs. I applied for COS from H4 to F1 for my spouse (already in collage) and H1 to F2 for me on 12/9/09. Meanwhile immigration performed spot check at my ex-employers on 12/3/09, so they came to know that i was not working. My employer had not revoked H1 by then. Our COS application was received by USCIS on 12/14/2009, case is currently under Initial Review.
- Will the immigration officers who did spot check inform USCIS that i was out of status?
- Will case get rejected due to delay in applying for COS?
- Will there be any complications in transferring my H1 to new employer as i was out of status for about a month before i applied for COS?
- How to stop F2 COS if i get H1 transfer approved first?

Hello,
I have an approved I140 and eligible to apply for I485. My wife is in the same situation.
Should we file separate? Or should I file only one application heither through my employer or hers?
Any clarification in this matter would be greatly appreciated.

Hi,
My situation -
I am a homemaker on H4 since 2007. ( My husband on H1 ).
Doing MS on H4 ( with few credits still to go )( not full time ).
H4 is due stamping ( Already extended till 2012 ).
Objective -
- To be on F1, to utilize CPT / OPT.
QUESTIONS -
QUESTION - - Which one is better H4 to F1 in US via change of status - I-539 ( BUT That
way i had to face the consulate again for F1 stamping ( Also, very few
credits are left with my MS as in now ))
OR
Directly F1 Visa stamping at
US consulate in India ( It'll be surely fast, that way i won't have to go back for stamping with very few credits left ) ?

On March 17, 2008, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before you get your new card call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
Eventhough I did not get notice yet by mail I am little confused and concerended with their message, I have couple of questions
1) Does this really means my AOS application is approved? Is there anything else I should do?
2) what is ADIT processing that they are referening to?
Any thoughts or experiences from the gurus here is really appreciated.

I had filed I 485 in EB3 category in July 2007 and my priority date is November 2006. I want to start the process under EB2 category also. My organization is very big and will not bend any rules to accomodate anything. There is a job posted in my organization with the following requirements -
Required Qualifications
A Bachelor's degree or equivalent training in Business Administration, Health Service Administration, Mathematics, Project Management or Industrial Engineering.
Five or more years of progressive experience in an exempt-level business analyst, project management or process improvement role.
My question to you is whether this job requirement classify this job in EB 2 category? Thanks.

USCIS has not extended its temporary accommodation for delays in the labor condition application (LCA) process. Earlier, USCIS agreed to accept H-1B petitions without a certified LCA, in certain situations, for a limited time. This exception was available from November 5, 2009 to March 9, 2010. The USCIS has declined to extend this exception. Accordingly, all H-1B petitions must be filed with the certified LCA otherwise USCIS will deny the H-1B petition or extension.

Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. Hi,
I'm on F1 visa and married to a GC holder. Should i apply for a dependent GC (I-130) on my husband's GC OR be on my F1 status untill the time he becomes citizen and then apply for the dependent GC?...What are the exact wait times for I-130 now?
If i dont apply for I-130 and go out of the country, will there be any issues while coming back to this country. What do you thing is the best way to go..
I'm ready to take some legal advice, so please let me know.

I saw soft LUDs on all our applications at NSC (pending 485s, 131s and approved 765s) on 12/12 and 12/15. This should mean some sort of system update on NSC, is it ? or should I look forward to good/bad news :confused: ? My PD is nowhere close to the current cut off date for EB2-I.

Family based green cards take a longish amount of time 5 yrs or so and your wife cannot enter US in that period. So if you plan to live with your wife in the US in the mean time here is an idea you can consider:
Give up your green card, then come back with H1 and your wife on H4 then reapply - you might get your green cards in 3-4 months because your 140 has an older priority date.

I know that. That's why we need to cancel it. We have to travel in November and we are concerned that AP may not arrive by then. Has anyone ever cancelled I-539 before it is approved?

I-140 is not specific to country - the date for each processing center applies to all countries
