ABC News has an interesting piece that discusses the birth tourism controversy and quotes a statistic that actually comes from Lindsey Graham's office. According to the National Center of Health Statistics, just 7,760 mothers report that they live outside the US of more than 4,000,000 births each year. Keep in mind that some of these mothers are actually US citizens who reside abroad but want to have their children in the US. So we're really talking about less than .2% of all births as being this huge problem that suddenly justifies overturning the 14th Amendment.

Recently i have joined a new employer after my H1 transfer has been applied, today i have recieved approval notice and its approved until October 15 2007,
were has my previous h1 was valid until October 2008. Please help how should i proceed ?

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. That's roughly the typical weekly usage we saw last year and if the pace doesn't change much, the cap will potentially be hit one to two months later than for FY2011. WASHINGTON -- Cracks are emerging in congressional Democrats' solidarity, as frustrated lawmakers concede their majority status is not enough to overcome Republican resistance on taxes, spending, Iraq and a host of other issues.
The fissures, which became obvious this week, are undermining Democrats' hopes for several key achievements this year. They also point to a bruising 2008 election in which Democrats will say Republicans blocked prudent tax and spending plans to score political points on immigration and other hot-button issues.
Republicans say they simply want to prevent higher taxes of any kind, even if the targets are not-so-sympathetic groups such as oil companies and hedge fund managers.
After 11 months of insisting that all major programs be paid for with tax increases or spending cuts elsewhere, Senate Democratic leaders acknowledged Thursday they cannot persuade enough Republicans to join them. Majority Leader Harry Reid, D-Nev., reluctantly allowed a vote on a long-debated middle-class tax cut that would add billions of dollars to the deficit because it is not offset elsewhere.
The measure, which the Senate approved 88-5, would prevent the alternative minimum tax from hitting about 25 million more taxpayers, at a cost of about $50 billion to the U.S. treasury next year. Reid's decision puts the Senate at odds with the House with two weeks left before the holiday recess.
House Democratic leaders still insist on a pay-as-you-go policy, or "pay-go," which they made a centerpiece of their governing principles in January.
Reid told reporters Thursday that Senate Republicans have used their filibuster powers to block Democratic efforts to change Iraq policy, move a farm bill and pay for the proposed one-year "fix" to the alternative minimum tax. He especially complained about Republican demands to offer farm bill amendments dealing with state drivers licenses for illegal immigrants.
"We've tried everything we can to address these issues," Reid said, citing 57 GOP filibuster threats this year.
"We have lived by pay-go," Reid said regarding the tax bill. "But what we want everyone to know is that we have tried every alternative possible."
He acknowledged handing a political dilemma to House Speaker Nancy Pelosi, D-Calif. The House earlier passed an AMT bill that would raise $80 billion in new taxes, largely on investors and hedge fund managers.
"I admire the speaker" for adhering to the pay-as-you-go principle, Reid said. He added, however, she "has a little more flexibility from a procedural perspective than I do."
Reid's decision will force a pivotal decision by House Democrats: Should they infuriate millions of voters by leaving the AMT unchanged (and hope Republicans get blamed), or abandon the pay-go promise and possibly rely heavily on Republican votes to pass a bill that splits Democrats.
"If we waive pay-go on this, I think it opens the door" to further actions that would raise the deficit and "border on criminal irresponsibility," said Rep. John Tanner, D-Tenn.
Meanwhile Thursday, congressional Democrats said they face an uphill battle in trying to overcome Senate GOP objections to a House-passed energy bill. Republicans particularly oppose the proposed rollback of $13.5 billion in tax breaks for major oil companies.
"You can't tax your way to energy independence," House Minority Leader John Boehner, R-Ohio, told reporters.
If the Senate cannot overcome the GOP-led resistance, Democratic senators said they may have to jettison provisions important to many House Democrats: the tax provisions and requirements for greater use of renewable energy such as wind, solar and biofuels.
House Ways and Means Committee Chairman Charles Rangel, D-N.Y., said such a move would be difficult for the House to swallow. "The tax part is just as important as any other part" of the energy bill, he said.
As for the Iraq war, congressional Democrats on Thursday sent their strongest signal yet that they are resigned to providing additional funds without forcing President Bush to alter his policies. The plan is virtually certain to divide House Democrats. Like the AMT legislation, it may require significant Republican support to pass.
Democrats, who sometimes seem incredulous at their inability to budge the GOP on tax, spending and war issues, say Republicans will pay dearly at the polls. "There is a sense they are digging their own grave," Sen. Charles Schumer, D-N.Y., said.
Some Republicans agree there is a risk in repeatedly blocking Democratic-crafted bills, especially if the chief beneficiaries appear to be big oil companies or wealthy investors.
"The strategy is to lay low and then blame them for not getting anything done," Republican Rep. Ray LaHood of Illinois said in an interview. "The truth is, we all lose."
"We trash each other and end up making the institution look bad," LaHood said. "That's why Congress' approval ratings are so low."

Folks,
I was on L1B and H1B for about 2.5 years around 2000-2003. I am now on TN for past 3-4 years and my current employer is going to chagne it to H1B.
The company HR and I are under the impression that this would require a new H1B application (by April 2nd to qualify for the upcoming year 2008 H1B quota). However, the company attorney told us that since I was on H1B in the past, so we don't need to file for a new H1B petition against the 2008 quota...rather we can activate my old H1-B at any time and use the remaining time from the 6 year period.
Does anyone know if there is any such provision to activate the old visa. I am under the impression that as I changed to TN status and no longer hold H1B, so it would require a new petition.
Your opinion would be appreciated.

There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

My 140 was filed for a future Team lead position. I am currently a Sr Sw Engg with the same employer. The job description is nearly the same. But I am not sure how this little quirk effects my AC21 eligibility. When does my 180 day start counting ? From filing date or from the date I get the Team lead title ?

News letter to members is a good first step...I would suggest a news letter every week with just fund rising and also increasing memebership in mind .The wording should be tuned towards rising $$.You can put on big bold wordings at the top % met versus our target..
Keep rowing guys we are almost there!!
Also..somebody with good writing skills write 1/2 page letter..about 8 different formats and wordings...so we can print them out and gives us a list of senators address...each member can spend 37 cents...even better fedex these to senators asking for support on the Skil Bill...

Just a passing thought - Would it help if members in each state meet (say on a Sunday) and come up with Strategies to mobilize more people in their respective states?
It will help the us organize better in each state. A senior member in each state would then coordinate and take strategy and activity related instructions and advice from immigrationvoice.org core members and implement those in his/her respective state.
If at all that is possible then immigrationvoice.org can maybe create statewise blogs or something that would update members in each states about upcoming activities.
Just a passing thought - Would it help if members in each state meet (say on a Sunday) and come up with Strategies to mobilize more people in their respective states?

Hi Folks
My wife was working in India all this time and I am in US. H1 expires end of 2010. I believe I used up my extension .
I got my EAD and AP already after I filed for my 485 under Eb2.
My Question is , how long can she go on H4 ? Only till my H1. If she comes to US on H4 can I file her EAD or do I have to wait for the category to be current to do so .
If its not possible to get her and EAD , and her H4 expires in 2010 ( assuming that her H4 is commensurate with my H1 Life span ) then what options do I have so that she is in status .
Please advise.
